Terms of service

Biyra generates videos from material you provide. You control whether, where, and how to publish them.

1. Who provides the service

These terms govern your use of Biyra. “Biyra,” “we,” “us,” and “our” mean Biyra and the individuals or entities that operate the service. “You” means the person using the service and any organization they are authorized to represent. Biyra is operated from California.

2. The service and your account

Biyra is an AI-assisted video-generation service, not a real-estate listing service, broker, agent, appraiser, inspector, or legal adviser. We do not create or place property listings on your behalf. You must be at least 18 and have authority to use the service for your organization. Keep account details accurate, protect credentials, and manage workspace access. Signup itself does not purchase credits or start generation.

3. Your source material and permissions

You are responsible for all photos, listing links, logos, names, property details, instructions, and other material you submit. You represent that you own or have all permissions necessary for us and our service providers to receive, copy, store, analyze, transform, and generate videos from that material, and for your intended use of the resulting videos.

Your permissions must cover applicable copyright, photographer and MLS licenses, brokerage and owner requirements, trademarks, privacy, and publicity rights. A public listing, a listing relationship, or access to a photograph does not itself grant reuse rights. Do not upload material if its license prohibits AI processing or the intended derivative use. Do not bypass source restrictions or access controls.

4. Limited permission to process your material

You retain your existing rights in source material. You grant Biyra a nonexclusive, worldwide license to host, reproduce, process, adapt, and transmit it, including through service providers, as reasonably necessary to generate and deliver your requested videos, maintain and secure the service, and resolve support or legal issues. This permission is limited by the Privacy and Data Retention policies. It does not authorize Biyra to use your material in public marketing without separate permission.

5. Generated videos and intellectual property

As between you and Biyra, you retain rights in your inputs and may use delivered videos for lawful purposes permitted by your source licenses and these terms. To the extent Biyra owns assignable rights in the generated video itself, Biyra assigns those rights to you upon settlement of the applicable generation charge. This excludes our software, tools, branding, and third-party material. AI output may not be unique or eligible for copyright protection; we do not guarantee exclusivity, copyright ownership, or freedom from third-party claims.

6. AI can make convincing mistakes

AI may invent, omit, or alter rooms, layout, dimensions, fixtures, finishes, furniture, views, boundaries, lighting, or other details. A generated video is not actual camera footage, a measured reconstruction, or proof of property condition. Automated planning and quality checks can miss errors and do not certify factual accuracy, legal compliance, or suitability.

You must review the complete video against authorized source photographs and independently verified property information before sharing, publishing, advertising, or relying on it. Correct, regenerate, or omit misleading material. An AI label does not make a materially misleading depiction acceptable.

7. Your publication and advertising decisions

You decide whether, where, and how to publish or distribute a video. You are responsible for the listing, captions, claims, audience targeting, permissions, broker or MLS approval, and required AI or editing disclosures and original-image access associated with your use. Follow applicable real-estate, advertising, fair-housing, privacy, and platform rules. Biyra does not verify your authority to list a property, publish listings for you, or certify your advertisement. Choosing an unlisted sharing link makes the video accessible to anyone who obtains that link.

8. Credits, retries, and refunds

The final quote is shown before you confirm generation. Confirmation reserves credits; successful completion settles the charge and eligible final failures or cancellations release the reservation under the Credits and Refunds policy. An automatic retry of the same operation does not create a second charge. A separately requested scene regeneration or new video can require a new quote and additional credits. Card purchases are currently unavailable in this beta. Nothing in these terms removes refund or other consumer rights required by law.

9. Availability and file retention

This is a developing beta. Features, capacity, generation times, and access may change or be interrupted. We do not guarantee uninterrupted service or a particular aesthetic result. Finished videos are available for seven days (168 hours) from release; download your own copy before expiry. Other files follow the Data Retention policy. Keep independent copies of original material. We do not promise permanent archiving.

10. Prohibited use and suspension

Follow the Acceptable Use Policy. Do not infringe rights, mislead viewers, discriminate unlawfully, expose private information, upload illegal or harmful content, circumvent limits, or interfere with accounts or systems. We may reject work, restrict sharing, suspend access, or terminate an account for a material breach, credible rights or safety concerns, legal requirements, or threats to service integrity. We will provide notice where reasonably practicable and lawful. Restrictions do not remove any refund or access rights required by law.

11. Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND GENERATED OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. This disclaimer does not exclude warranties or obligations that cannot lawfully be excluded, or excuse fraud, willful misconduct, or other liability that applicable law prohibits us from disclaiming.

12. Limits on liability

To the maximum extent permitted by applicable law, Biyra and its operators are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or lost profits, business opportunities, goodwill, or data, arising from the service or your use or publication of outputs. Subject to the exceptions below, their aggregate liability arising out of the service or these terms will not exceed the greater of US $100 or the amount you paid Biyra for the service in the twelve months before the event giving rise to the claim.

These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, or any liability, statutory remedy, or consumer or privacy right that cannot lawfully be excluded or limited. In particular, nothing here excludes responsibility contrary to California Civil Code section 1668. The limits apply only to the extent lawful in your circumstances.

13. Responsibility for third-party claims

To the extent permitted by law, you will indemnify Biyra and its operators against third-party claims and reasonable resulting costs, damages, and legal fees to the extent caused by your breach of these terms, infringement through material you supply, unlawful instructions, or unlawful or misleading publication or distribution you control. This does not cover claims caused by Biyra’s own wrongful conduct or nonwaivable duties. We will notify you of a claim, provide reasonable cooperation, and allow reasonable participation in its defense. Neither party may settle a claim imposing an admission, payment, or obligation on the other without that party’s consent, which must not be unreasonably withheld.

14. California law and disputes

California law governs these terms, without displacing mandatory protections that apply where you live. Courts with lawful jurisdiction in California may hear disputes, subject to any nonwaivable venue or consumer rights. These terms do not require arbitration or waive small-claims access. You may contact us to seek an informal resolution; doing so is not a prerequisite to exercising legal rights.

15. Policies, changes, and contact

The Acceptable Use, Credits and Refunds, Copyright, AI and Property Accuracy, and Fair Housing guidelines explain related use requirements. The Privacy and Data Retention policies describe information handling. Updated terms will display a new date; we will provide conspicuous notice of material changes before they take effect and obtain renewed agreement where required. Changes do not retroactively remove accrued rights. If a provision is unenforceable, the rest remains effective to the extent lawful.
