Do you have to disclose virtual staging? Rules for agents

Yes, in most cases. California has required disclosure of digitally altered listing images since January 1, 2026, and many MLSs require staged or altered photos to be labeled, often alongside the original. Rules differ by state and MLS, so check yours before publishing. This guide is general information, not legal advice.

California: Business and Professions Code section 10140.8

California’s AB 723, in effect from January 1, 2026, requires brokers and salespersons who use a digitally altered image in listing advertising to say that the image has been altered and to give a link, URL or QR code to the unaltered original. The statement must be reasonably conspicuous and on or next to the image.

Routine adjustments such as lighting, white balance, cropping and exposure are generally not treated as alterations when they do not change how the property is represented. Adding or removing furniture, fixtures or landscaping is.

MLS rules

Many MLSs have their own requirements on top of state law. Common rules include labeling altered photos in the image or caption, uploading the unaltered original next to it, not using an altered photo as the primary image, and fines for photos that are not disclosed. Read your MLS’s current photo policy.

A practical checklist

Label every virtually staged photo, for example “Virtually staged”.
Keep and publish the original photo where your MLS or state requires it.
Do not hide defects or change fixed features such as walls, windows, flooring or views.
Apply the same labels on social media and your own website.
Treat AI video made from altered photos the same way.
